These Terms of Service (“Terms”) govern your use of the Tesla Controller Bridge website and firmware flashing service (the “Service”), accessible at https://teslacb.com (the “Site”), developed and published by Whale Laboratories, Inc. (“Tesla Controller Bridge,” “us,” or “we”).
BY USING THE SERVICE, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MAY NOT USE THE SERVICE.
1. The Service
1.1 Eligibility and Registration
Certain features of the Service require registration via email authentication. You must provide accurate information during registration. We may approve or decline registration at our sole discretion.
1.2 Description of the Service
Tesla Controller Bridge provides browser-based firmware that can be flashed onto compatible ESP32 microcontroller boards using the Web Serial API. The firmware enables Xbox Series X|S controllers to connect to Tesla vehicles via Bluetooth for use with Tesla games that have controller support. The Service includes a free trial tier and a paid full tier.
1.3 Hardware Disclaimer
Tesla Controller Bridge is not responsible for any damage to your ESP32 device, Xbox controller, Tesla vehicle, or any other hardware resulting from the use of our firmware or Service. Flashing firmware to your ESP32 is done at your own risk. You are solely responsible for ensuring compatibility of your hardware with the Service.
1.4 Safety
You must always be aware of your surroundings when using Tesla Controller Bridge. Gaming in your vehicle should only be done while your vehicle is safely parked. Never use the Service while driving or in an unsafe location.
1.5 Data Collection and Use
We collect data necessary to provide the Service, including account information, purchase records, and usage analytics. We may collect aggregated, de-identified data from your use of the Service (“Aggregate Data”) and retain sole ownership of such data for internal business purposes including product development, research, and improvement of the Service.
1.6 Third-Party Content
The Service may provide links to content provided by third parties, including hardware retailers and driver downloads. We do not endorse and are not liable for any third-party content accessible via the Service.
2. Term and Termination
These Terms take effect when you first access the Service and remain in effect until terminated. We may terminate these Terms or your access to the Service at any time for any reason upon notice. Upon termination, you must immediately cease all use of the Service. Sections 3(c), 3(d), 4, 5, 6, and 7 survive termination.
3. License and Ownership
3.1 License Grant
Subject to your compliance with these Terms, we grant you a limited, revocable, royalty-free, non-transferable, non-sublicensable, and non-exclusive license to use the Service for personal, non-commercial use. For paid users, this license covers up to two (2) active ESP32 devices at a time.
3.2 Restrictions
You shall not:
- Reverse engineer, decompile, modify, or create derivative works from the firmware or Service, or attempt to discover any source code or underlying algorithms;
- Attempt to disable or circumvent any intellectual property protection mechanisms in the firmware or Service;
- Use the Service for commercial purposes, including reselling flashed devices or developing competing products;
- Reproduce, distribute, or publicly display the firmware or any aspect of the Service;
- Share your account credentials or allow unauthorized persons to access the Service through your account.
3.3 Ownership
Whale Laboratories, Inc. is and will remain the exclusive owner of all patents, copyrights, trademarks, trade secrets, and other intellectual property rights in and to the Service and firmware. All rights not specifically granted in these Terms are reserved. The firmware is licensed, not sold.
3.4 Feedback
If you provide suggestions or feedback regarding the Service, you grant us a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sublicensable, and transferable license to use, copy, modify, and exploit such feedback without restriction.
4. Purchases and Refunds
Purchases are processed by Stripe. We do not directly store your payment card information. All sales are final. Since the free tier allows you to test the firmware before purchasing, refunds are generally not provided. 5. Disclaimer of Warranties
THE SERVICE AND FIRMWARE ARE PROVIDED ON AN “AS IS” BASIS. WE DO NOT REPRESENT OR WARRANT THAT THE SERVICE (I) WILL BE UNINTERRUPTED OR SECURE, (II) WILL BE FREE OF DEFECTS, INACCURACIES, OR ERRORS, (III) WILL MEET YOUR REQUIREMENTS, OR (IV) WILL OPERATE WITH ALL HARDWARE OR SOFTWARE CONFIGURATIONS. WE MAKE NO WARRANTIES WHATSOEVER, AND HEREBY DISCLAIM ANY AND ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. TESLA CONTROLLER BRIDGE IS NOT AFFILIATED WITH, ENDORSED BY, OR SPONSORED BY TESLA, INC., ALPHABET INC., MICROSOFT CORPORATION, OR ESPRESSIF SYSTEMS.
6. Limitation of Liability
IN NO EVENT WILL WHALE LABORATORIES, INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, OR DAMAGES TO HARDWARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID TO US BY YOU OR $100, WHICHEVER IS GREATER. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS WHALE LABORATORIES, INC. FROM ANY CLAIMS ARISING FROM YOUR VIOLATION OF APPLICABLE LAW, MISUSE OF THE SERVICE, OR NEGLIGENCE.
7. General Provisions
7.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal action arising under these Terms will be brought exclusively in the federal or state courts located in Los Angeles, California.
7.2 Notices
All notices under these Terms will be in writing and sent to [email protected] or to the email address associated with your account.
7.3 Miscellaneous
You may not assign or transfer these Terms without our prior written consent. We may freely assign our rights and obligations. These Terms constitute the complete agreement between the parties regarding the Service. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision does not constitute a waiver.
